Terms & Conditions.
The terms on which you may use this website and the Owner Portal. Our services themselves are governed by the management agreement you sign with us.
This page is a working draft prepared for review. It has not been checked or signed off by a solicitor, and every item marked [CONFIRM: …] is a fact still to be supplied or verified before publication.
1. Who we are
This website is operated by Redpoint Property Group Ltd, a company registered in England & Wales under company number 16306988, whose registered office is at 31 Church Road, Manchester M22 4NN. In these terms, “Redpoint”, “we” and “us” mean that company.
2. About these terms
These terms govern your use of this website. By using the site you accept them. If you do not accept them, please stop using the site.
These terms do not govern the services we provide. Property management, lettings and any other work we do for you is governed by a separate written agreement signed by both of us. Where these terms and that agreement differ, the signed agreement wins.
3. Using this website
You may use this site for your own lawful purposes. You may not:
- Use it in any way that breaks the law, or that could damage or disrupt it.
- Attempt to gain access to any part of it, or any account, server or system connected to it, that you are not authorised to reach.
- Copy, scrape or republish its content or images other than as set out below.
- Introduce malware, or attempt any denial-of-service attack.
We may suspend or withdraw access to the site, or to any account, if you break these terms.
4. The Owner Portal
The Owner Portal is for clients of Redpoint. If you hold a login:
- Keep your password confidential and do not share your account with anyone else.
- Tell us straight away if you think someone else has your login details.
- You are responsible for what is done through your account.
Information shown in the Portal is provided for your convenience. Statements, certificates and formal notices we issue to you separately are the definitive record.
5. Property information and listings
Property particulars, photographs, floor areas, rents, yields, service charges and completion dates on this site are given in good faith as a general guide. They are not an offer or part of any contract. They may change, and properties may be withdrawn without notice.
Anything about past or projected performance is not a promise about the future. Property values and rental income can fall as well as rise.
You should satisfy yourself about any property through your own inspection, survey and professional advice before committing to anything.
6. This is not advice
Nothing on this site is legal, tax, mortgage, investment or financial advice, and nothing on it should be relied on as a recommendation to buy, sell or let. Take your own professional advice for your own circumstances.
7. Our services and fees
The services described on this site are outlines, not a fixed specification. What we will actually do for you, what it costs and how it can be ended is set out in your management agreement and fee schedule.
[CONFIRM: whether a published fee schedule should be linked here. Letting agents in England must display their fees and certain memberships prominently on their website under the Consumer Rights Act 2015 and the Tenant Fees Act 2019 — confirm with legal counsel which of these duties apply to Redpoint and add the required disclosures]
8. Regulatory memberships
The memberships and registrations below are being put in place. Each will be published here, with its membership number, only once it is confirmed — we do not display a badge we have not earned.
| Scheme | Status |
|---|---|
| Property redress scheme | [CONFIRM: The Property Ombudsman or Property Redress Scheme, and the membership number. Membership is a legal requirement for lettings and property management work in England] |
| Client Money Protection | [CONFIRM: the CMP scheme and membership number, and the address of the certificate. Required for property agents holding client money in England] |
| Tenancy deposit scheme | [CONFIRM: the scheme and membership number] |
| ICO data protection register | [CONFIRM: registration number] |
| Anti-money-laundering supervision | [CONFIRM: whether HMRC registration is required for the work Redpoint does, and the registration number if so] |
9. Intellectual property
We own or are licensed to use everything on this site, including the Redpoint name and logo, the text, the photographs and the design. You may view it, and print or download extracts for your own reference. You may not use any of it commercially, or republish it, without our written permission.
10. Links to other sites
Where we link to another website, that is for information only. We do not control those sites and we are not responsible for their content or for what they do with your data.
11. Availability
We try to keep the site and the Owner Portal available, but we do not guarantee it. We may suspend, withdraw or change any part of them without notice, including for maintenance.
12. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, we exclude all implied conditions and warranties to the extent the law allows, and we are not liable for any loss of profit, loss of business, business interruption or loss of anticipated savings arising from your use of this site or from anything on it.
If you are a consumer, this does not affect your statutory rights.
[CONFIRM: the liability wording with legal counsel, including whether a financial cap should be stated, before this page is published]
13. Privacy
How we handle personal data is set out in our privacy notice.
14. Complaints
If something has gone wrong, our complaints procedure explains how to raise it and what happens next.
15. Changes to these terms
We may change these terms. The version on this page at the time you use the site is the one that applies, so please check it from time to time.
16. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
[CONFIRM: this clause with legal counsel. Many Redpoint clients are consumers resident overseas, and a consumer may keep the right to bring a claim in the courts of the country they live in whatever this clause says]
